Terms of service

These Terms of Service apply when you access or purchase from The Vault through the-vault.com.au.

In these terms, “The Vault”, “we”, “us” and “our” refer to the operator of The Vault. “You” and “your” refer to the customer or website visitor.

By using our website or placing an order, you agree to these terms, our Return and Refund Policy, Shipping Policy and Privacy Policy.

Nothing in these terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded, including rights under the Australian Consumer Law.

1. Online store

The Vault sells trading-card products, including singles, sealed products, accessories and other related items.

You must provide accurate, current and complete information when placing an order. You are responsible for checking your delivery address, email address and order details before completing checkout.

You must not use our website for unlawful, fraudulent or unauthorised purposes.

2. Product information

We aim to make product titles, descriptions, images, set details, finishes, quantities and prices as accurate as reasonably possible.

Colours and appearance may vary slightly depending on lighting, photography and your device screen.

For trading-card singles, the product title, set code, collector number, finish and product image are used to identify the printing being offered.

Where a listing contains an error, contact us so it can be reviewed and corrected.

3. Trading-card condition

Unless otherwise stated, trading-card singles are supplied in a condition suitable for normal collecting and play.

Minor manufacturing variations may occur, including centring differences, print lines, surface marks, edge wear or other factory-related imperfections.

Any material damage or condition issue known to us will be disclosed where reasonably possible.

Customers seeking a particular grading standard, centring quality or condition for a high-value card should contact us before ordering.

4. Sealed products and random contents

The contents of sealed booster packs, booster boxes, bundles and similar products are random unless expressly stated otherwise.

Purchasing a sealed or randomised trading-card product does not guarantee any particular card, rarity, treatment, monetary value, pull rate or financial return.

Product odds, configurations and contents are determined by the manufacturer and may vary between products.

5. Prices

All prices displayed on the website are in Australian dollars unless otherwise stated.

Prices may change without notice. A price change will not affect an order that has already been accepted, except where required or permitted by law.

We aim to display clear and accurate prices. If a pricing or listing error is identified, we may pause fulfilment and contact you before proceeding. Where Australian Consumer Law requires, we will honour the lowest displayed price or stop offering the product until the error is corrected.

Shipping charges and any other applicable costs are displayed before checkout is completed.

6. Orders

Submitting an order does not guarantee that the product is available or that the order will be accepted.

We may decline or cancel an order where:

  • A product is unavailable
  • Payment cannot be authorised
  • The order appears fraudulent or presents a security risk
  • The delivery address cannot be serviced
  • A product or pricing error requires the item to be withdrawn
  • The purchase breaches these terms or applicable law

If payment has been taken for an order we cannot supply, we will contact you and provide an appropriate refund or other solution. Businesses that cannot supply a paid product must provide a remedy.

We may limit quantities where reasonably necessary to protect inventory availability or prevent suspected fraudulent or unauthorised resale activity.

7. Payment

Payment must be completed using one of the payment methods available at checkout.

You confirm that you are authorised to use the payment method selected.

Orders may be held while payment, identity, address or fraud checks are completed.

8. Preorders

A preorder is an order placed for a product before its expected release or availability date.

Release dates, supplier allocations and delivery estimates may change due to circumstances outside our control.

Where possible, we will notify affected customers of significant delays or allocation changes.

If we cannot fulfil a preorder, we will provide a refund for the unavailable product.

Orders containing preorder and in-stock products may be shipped together when the preorder becomes available unless separate shipping arrangements are offered or agreed.

9. Specially sourced products

Products obtained specifically in response to a customer’s sourcing request may be subject to additional terms disclosed before the customer confirms the purchase.

Once sourcing has commenced or a supplier commitment has been made, change-of-mind cancellation may not be available.

This does not affect rights available under Australian Consumer Law.

10. Shipping and delivery

Shipping timeframes are estimates and are not guaranteed unless expressly stated.

Customers are responsible for supplying a complete and accurate delivery address.

Risk relating to an incorrectly entered address may remain with the customer where an order has already been dispatched, subject to applicable law.

11. Returns and refunds

Returns, refunds, store credits and change-of-mind requests are handled under our Return and Refund Policy.

Nothing in that policy or these terms limits your rights where goods fail to meet a consumer guarantee.

Consumer guarantees apply automatically and cannot be removed by store terms, time limits or “no refund” statements.

12. Website availability

We aim to keep the website available and accurate, but uninterrupted access is not guaranteed.

We may update, suspend or modify parts of the website where reasonably necessary for maintenance, security, product updates or business operations.

13. Accounts and security

Where customer accounts are available, you are responsible for maintaining the confidentiality of your login information.

Notify us promptly if you believe your account or payment information has been used without authorisation.

We may restrict or suspend an account where reasonably necessary to investigate suspected fraud, misuse or security concerns.

14. Intellectual property

The Vault’s original branding, website content, written material, layouts and graphics may not be copied, reproduced or commercially used without permission.

Trading-card names, game names, artwork, characters, logos and other third-party intellectual property belong to their respective owners.

The Vault is an independent retailer and is not affiliated with or endorsed by a publisher or rights holder unless expressly stated.

15. Reviews and submitted content

Where you submit a review, image, comment or other content, you confirm that:

  • The content reflects your genuine experience
  • You have the right to submit it
  • It is not unlawful, deceptive, defamatory or infringing
  • It does not contain malicious code or confidential information

We may moderate or remove content that breaches these conditions. We will not manipulate reviews or make misleading claims about customer feedback.

16. Third-party services and links

Our website may use or link to services provided by Shopify, payment processors, delivery providers, social-media platforms and other third parties.

Those services may be governed by their own terms and privacy policies. We are not responsible for third-party websites or services outside our reasonable control, except where liability cannot lawfully be excluded.

17. Liability

To the maximum extent permitted by law, The Vault is not responsible for indirect or consequential loss arising from circumstances outside our reasonable control.

This limitation does not apply where liability cannot lawfully be excluded or limited, including liability arising under applicable consumer guarantees.

18. Changes to these terms

We may update these terms when our products, services, systems or legal obligations change.

The version applying to an order is generally the version published when that order was placed, unless a change is required by law.

The current version and its last-updated date will remain available on our website.

19. Governing law

These terms are governed by the laws applying in Queensland, Australia.

Nothing in this section prevents a customer from exercising rights available under applicable Australian consumer law or bringing a matter before a court or tribunal with lawful jurisdiction.
